This Privacy Policy (“Privacy Policy”) is designed to help you understand how Maiaki, Inc. collects, uses and safeguards the information you provide to us and to assist you in making informed decisions when using our online platform available at http://www.maiaki.com (“Site”) and all related services (collectively with the Site, the “Service”).  Capitalized terms used but not defined herein have the meanings set forth in the Maiaki Terms of Service.  By accessing or using any part of the Service, you consent to our collection, storage, use and disclosure of your information, including your personal information, as described in this Privacy Policy.



                We collect and store “Non-Personal Information” and “Personal Information.”  Non-Personal Information includes information that cannot reasonably be used to personally identify you, such as anonymous usage data, general demographic information we may collect, referring/exit pages and URLs, platform types, preferences you submit and preferences that are generated based on the data you submit and number of clicks.  Personal Information may include your name, email address, telephone number, and other personally identifiable information that you voluntarily submit to us on or in connection with the Service.

                1. Information collected via technology

                In an effort to improve the quality of the Service, we track information provided to us by your browser when you view the Site, such as the website you came from (known as the “referring URL”), the time and date of access, and other information that does not personally identify you and store it in log files.  We track this information using cookies, or small text files which include an anonymous unique identifier.  Cookies are sent to a user’s browser from our servers and are stored on the user’s computer hard drive.  Sending a cookie to a user’s browser enables us to collect Non-Personal information about that user and keep a record of the user’s preferences when utilizing our Site, both on an individual and aggregate basis.

                Maiaki may use both persistent and session cookies; persistent cookies remain on your computer after you close your session and until you delete them, while session cookies expire when you close your browser.  For example, we may store a persistent cookie to enable us to pre-populate form fields that you have previously completed on the Site.  Although you can disable cookies on your device by indicating this in the preferences or options menu in your browser, doing so may limit your ability to view or use the Site and/or Service.

                2. Information you provide us

                In addition to the information provided automatically by your browser when you visit the Site, you may voluntarily provide us with Personal Information when you contact us, place a Product order, or otherwise use the Service.  Personal Information you provide or submit to us may include your name, email address, telephone number, company affiliation, mailing address, billing address and other personally identifiable information which you voluntarily submit to us through the Service.  If you contact us through the Service with a support question, we will also collect your browser name and version and a description of your support problem.  By submitting this information, you are authorizing us to collect, store and use your Personal Information in accordance with this Privacy Policy.

                If you purchase or offer for sale any Products through the Service, we will ask you to provide certain Personal Information, including your name, email address and zip code, as well as payment card or payment method information. We use this Personal Information for billing purposes and to fulfill your purchases. If we have trouble processing the transaction, we will also use this information to contact you. Your payment method information and billing address information is collected and stored by Maiaki’s third-party payment processors, including Stripe, Inc., Escrow.com, Inc. and PayPal, Inc.                 3. Children’s Privacy

                Maiaki does not knowingly collect or solicit information from anyone under the age of 13 and no one under age 13 is permitted to provide any information to Maiaki.  If you are under 13, please do not attempt to send any information about you to us, including your name, address, telephone number, or email address.



                Personal Information

                Except as otherwise stated in this Privacy Policy, we do not sell, trade, rent or otherwise share for marketing purposes your Personal Information with third parties without your consent. We do share Personal Information with vendors who are performing services for Maiaki, including but not limited to Payment Processors and shipping service providers, including INTTRA, Inc. (“INTTRA”).  INTTRA’s privacy policy is available at http://www.inttra.com/legal/privacy-policy.  We do not control and are not responsible for the privacy practices and policies of the Payment Processers, INTTRA, or other third parties.

                In general, the Personal Information you provide to us is used to help us communicate with you and to provide the Service.  For example, we use Personal Information to administer or process a transaction, to contact users in response to questions, to provide technical support, and to inform users about promotional offers regarding products or services offered by Maiaki.  If you join one of our mailing lists or otherwise submit Personal Information through the Service, we will use that information for the purpose for which it was collected and for other reasonably related purposes we determine are appropriate.

                We may use and disclose Personal Information to detect, prevent and otherwise address fraud or security issues, and to protect the rights, property, safety and security of Maiaki and its employees, other users of the Service, and/or the public.  We reserve the right to disclose Personal Information to regulatory authorities, law enforcement agencies or as required by applicable law.

                Non-Personal Information and Aggregated Information

                In general, we use Non-Personal Information to help us improve the Service and customize the user experience.  We also aggregate information in order to track trends and analyze use patterns on the Site, and generally to improve the Service.  Such aggregated information cannot reasonably be used to identify you.  This Privacy Policy does not limit in any way our use or disclosure of Non-Personal Information and aggregated information and we reserve the right to use and disclose such Non-Personal Information and aggregated information to our partners, advertisers and other third parties at our discretion.

                We also use analytics services such as Google Analytics to help Maiaki understand how users use the Service. These analytics services allow us to analyze all types of data received from users to generate reports about aggregate user behavior on our Service and help us to measure and research its effectiveness.                 Business Transfers

                In the event we undergo a business transaction such as a merger with or acquisition by another company, or sale of all or a portion of our assets, your Personal Information may be among the assets transferred.  You acknowledge and consent that such transfers may occur and are permitted by this Privacy Policy, and that any acquirer of our assets may continue to process your Personal Information as set forth in this Privacy Policy.  If our information practices change at any time in the future, we will post the policy changes to the Site so that you may opt out of the new information practices.  We suggest that you check the Site periodically if you are concerned about how your information is used.

                Retention of Personal Information

                Maiaki will retain your Personal Information for the period necessary to fulfill the purposes outlined in this Privacy Policy unless a longer retention period is required or permitted by law.


                We implement commercially reasonable security measures designed to protect your information from unauthorized access by implementing certain technological security measures including encryption, firewalls and secure socket layer technology.  However, these measures do not guarantee that your information will not be accessed, disclosed, altered or destroyed by breach of such firewalls and secure server software.  By using the Service, you acknowledge and agree to assume these risks.


                You have the right at any time to prevent us from contacting you for marketing purposes.  When we send a promotional communication to a user, the user can opt-out of further promotional communications by following the unsubscribe instructions provided in each promotional e-mail.  You can also indicate that you do not wish to receive marketing communications from us by emailing unsubscribe@maiaki.com.  Please note that, notwithstanding the promotional preferences you indicate by either unsubscribing or opting out, we may continue to send you administrative emails including, for example, periodic updates to our Privacy Policy.


                We may provide links to other websites or applications on or in connection with the Service.  However, we are not responsible for the privacy practices employed by those websites or applications or the information or content they contain.  This Privacy Policy applies solely to information collected by us through the Site.  Therefore, this Privacy Policy does not apply to your use of a third party website or application accessed by selecting a link on our Site.  To the extent that you access or use the Site through or on another website or application, then the privacy policy of that other website or application will apply to your access or use of that site or application.  We encourage our users to read the privacy statements of other websites before proceeding to use them.


                Maiaki reserves the right to change this Privacy Policy and our Terms of Use at any time, without notice to you. Any modifications will be effective immediately as of the date the modified Privacy Policy is posted on the Site. By continuing to access or use the Service after we have posted a modification, you are indicating that you agree to be bound by the modified Privacy Policy.                 The Service is provided in the United States of America and our policies are directed at compliance with the laws of the United States of America and its constituent jurisdictions.
